Waste Disposal Roehampton Service Terms

These Terms and Conditions govern the provision of waste disposal and rubbish collection services by Waste Disposal Roehampton to customers within Roehampton and surrounding areas. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means any individual, business, landlord, managing agent or organisation who books or uses our services.

Company, we, us or our means Waste Disposal Roehampton, the provider of waste disposal and collection services.

Services means waste disposal, rubbish removal, refuse collection, recycling collection, site clearance or related services provided by the Company.

Booking means a confirmed request for Services made by the Customer via telephone, email, website form or other approved communication channel.

Waste means any materials, rubbish, refuse or items presented by the Customer for collection, removal or disposal.

2. Scope of Services

The Company provides domestic and commercial waste disposal services, including but not limited to bulky waste removal, household rubbish collection, garden waste clearance, light construction waste removal and recycling collections.

Services are generally available within Roehampton and nearby areas, subject to the Company’s operational coverage and capacity on the relevant date. The Company reserves the right to decline or reschedule a Booking where access, distance, traffic restrictions or local conditions make provision of the Services impractical or uneconomic.

The exact nature and scope of the Services to be provided on any visit will be as agreed at the time of Booking and confirmed in the price quote or service confirmation issued by the Company.

3. Booking Process

Customers may request a quote and make a Booking by contacting the Company via telephone, email or online enquiry form. In order to provide an accurate quote and confirm a Booking, the Customer must provide full and accurate information, including:

1. The address where the Services are to be carried out.

2. A description of the type and approximate volume or weight of Waste.

3. Any access restrictions such as parking limitations, stairs, narrow entrances or timed entry systems.

4. Preferred dates and times for collection.

The Company may request photographs or additional information about the Waste and the collection location in order to provide a more accurate estimate.

A Booking is only confirmed once the Company has accepted the request and issued confirmation, which may be given verbally, by email or by electronic message. Provisional or indicative quotes do not constitute a confirmed Booking.

4. Service Times and Access

The Company will use reasonable endeavours to attend the collection address on the agreed date and within the estimated time window. All timings are approximate and may be affected by traffic, weather, operational issues or unforeseen circumstances. Time is not of the essence for the performance of the Services.

The Customer must ensure that the Company has safe, reasonable and uninterrupted access to the collection point at the agreed time. This includes arranging parking permits where necessary, ensuring gates and communal areas are accessible, and providing clear instructions for access codes or keys if required.

If the Company is unable to complete the Services due to inadequate access, parking restrictions, the Customer’s absence, or incomplete or inaccurate information, the Company may at its discretion apply a call-out charge or minimum fee to cover wasted time and costs.

5. Pricing and Quotations

Unless otherwise stated, prices quoted by the Company are based on the information provided by the Customer regarding the type, volume and nature of the Waste, and on standard access conditions at the collection address.

Quotes may be provided as a fixed price or as an estimate, depending on the information available. Where the actual volume or weight of Waste, or the nature of access, differs substantially from that described by the Customer at the time of Booking, the Company reserves the right to adjust the price accordingly.

Additional charges may apply for:

1. Excessive loading distances or difficult access.

2. Heavy materials such as soil, rubble or construction waste.

3. Waiting time caused by delays beyond the Company’s control.

4. Special handling requirements, including segregation or packaging.

The Company will inform the Customer of any price adjustments before commencing the Services wherever reasonably practicable. If the Customer declines the revised price, the Company may charge a reasonable attendance or call-out fee.

6. Payment Terms

Payment is due at the time of service unless alternative arrangements have been agreed in advance in writing. The Company accepts payment by cash, card or other electronic means as notified to the Customer.

For business Customers with approved credit accounts, payment shall be due within the period stated on the invoice, generally within 14 or 30 days of the invoice date. The Company reserves the right to carry out credit checks before granting credit terms and may withdraw or vary credit limits at any time.

If the Customer fails to make payment when due, the Company may charge interest on the overdue amount at the statutory rate permitted under the Late Payment of Commercial Debts legislation, as well as reasonable debt recovery costs.

The Company retains the right to suspend or refuse further Services where invoices remain unpaid.

7. Cancellations and Amendments

The Customer may cancel or amend a Booking by contacting the Company during normal business hours. The following terms apply:

1. If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

2. If the Customer cancels within 24 hours of the scheduled collection time, the Company may charge a cancellation fee to cover administrative and scheduling costs.

3. If the Customer cancels upon arrival of the collection crew at the site, or fails to provide access, the Company may charge a minimum load fee or call-out fee.

The Company may need to cancel or reschedule a Booking in exceptional circumstances, including severe weather, operational difficulties or safety concerns. In such cases, the Company will notify the Customer as soon as reasonably possible and rearrange the Booking at a mutually convenient time. The Company shall not be liable for any indirect losses arising from cancellation or rescheduling.

8. Customer Responsibilities

The Customer is responsible for:

1. Providing accurate information about the Waste and the collection location.

2. Ensuring that Waste is presented in a safe and accessible manner, free from sharp hazards or dangerous obstructions.

3. Separating Waste where required, for example segregating recyclables or keeping hazardous items apart from general rubbish.

4. Complying with any local rules imposed by building management, estate managers or landlords regarding refuse areas and access.

5. Ensuring that no prohibited or hazardous materials are included in the Waste unless previously declared and specifically agreed with the Company.

Where the Customer fails to meet these responsibilities, the Company may decline to remove some or all of the Waste and may charge in full for attendance.

9. Waste Types and Prohibited Materials

The Company handles a wide range of general household, commercial and bulky Waste, subject to applicable laws and licensing conditions. Certain wastes are restricted or prohibited, including but not limited to:

1. Asbestos or asbestos-contaminated materials.

2. Clinical or medical waste, syringes and pharmaceuticals.

3. Chemicals, solvents, paints, oils, fuels and other hazardous liquids.

4. Gas bottles, pressurised containers and certain electrical items requiring special treatment.

5. Radioactive materials or other regulated hazardous waste.

The Customer must declare in advance any Waste that may be hazardous or require special handling. The Company may at its discretion accept such Waste subject to additional charges and regulatory requirements, or may decline to remove it.

If prohibited or undeclared hazardous materials are discovered among the Waste at the point of collection or afterwards, the Company may return the material to the Customer, charge additional fees for safe handling and disposal, and recover any fines or costs imposed by authorities or disposal facilities.

10. Compliance with Waste Regulations

The Company operates in accordance with relevant UK waste management law and guidance. All Waste collected will be transported and disposed of at authorised facilities or via licensed transfer and treatment operations where required.

Where legislation requires the completion of a waste transfer note or similar documentation, the Customer agrees to provide information reasonably requested by the Company and to retain copies of documentation where applicable to their business activities.

The Customer warrants that it has the legal right to arrange for disposal of the Waste and that the Waste does not originate from any unlawful activity. The Customer shall indemnify the Company against any liability, fines or costs arising from a breach of this warranty.

11. Liability and Insurance

The Company shall exercise reasonable care and skill in providing the Services. However, the Company’s total liability to the Customer, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Services giving rise to the claim.

The Company shall not be liable for:

1. Any loss of profit, loss of business, costs of alternative arrangements or other indirect or consequential losses.

2. Damage arising from pre-existing structural defects, poor building condition or improper installation of fixtures and fittings.

3. Damage or loss where the Customer has failed to disclose relevant information about access constraints, fragile surfaces or sensitive items.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

The Company maintains appropriate public liability insurance and, where necessary, employer’s liability insurance, and will provide summary details on request.

12. Damage to Property

The Customer must notify the Company of any alleged damage to property caused by the Company’s crew as soon as reasonably possible and in any event within 48 hours of completion of the Services. The Customer should provide photographs and a clear description of the issue.

The Company reserves the right to inspect the alleged damage before any remedial action or compensation is agreed. Where damage is proven to be caused directly by the Company’s negligence, the Company may at its option arrange repair, replacement or a reasonable financial settlement, subject to the liability limits set out in these Terms and Conditions.

13. Ownership and Risk in Waste

Ownership and risk in the Waste passes to the Company once it has been loaded onto the Company’s vehicle, provided that the Customer has complied with these Terms and Conditions and the Waste is lawful to collect and dispose of.

If any Waste is later found to be illegal, hazardous without prior declaration, or otherwise non-compliant, the Company may at its discretion return such Waste to the Customer or arrange alternative treatment and seek reimbursement of all costs, charges, penalties or fines incurred.

14. Privacy and Data Protection

The Company may collect and process personal data relating to Customers, including contact details, service addresses, billing information and communication records, for the purposes of managing Bookings, providing Services, processing payments and maintaining business records.

Personal data will be handled in accordance with applicable UK data protection law. The Company will take reasonable steps to protect personal data from unauthorised access or disclosure and will not sell customer data to third parties. Data may be shared with service partners, payment processors or regulatory bodies where necessary for the performance of the Services or compliance with law.

15. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to extreme weather, accidents, road closures, strikes, utility outages, civil unrest or acts of government.

In such circumstances, the Company may suspend Services for the duration of the event or agree a revised timetable with the Customer once the event has passed.

16. Variations to Terms

The Company may amend these Terms and Conditions from time to time to reflect changes in law, regulatory guidance, operational practices or market conditions. Updated Terms and Conditions will apply to new Bookings from the date of publication or notification. For ongoing contracts, the Company will provide reasonable notice of significant changes.

17. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be interpreted in a way that most closely reflects the original intent, consistent with applicable law.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or their subject matter.
